Labour contract license

The Indian Legislature has incorporated the Contract labour or Regulation and Abolition act from 1970. The law enables to forbid the employment of labour contract in specific circumstances and to control the working conditions of the labour contract during the profession.

The Labour Contract License Applicability:

The Labour Contract Act applies to entities like

It applies to any contractor who employed or employed twenty or more workers on any day of the year of accounting.

It applies to any establishment in which more than twenty workmen are employed on any day of the year of accounting as contract labour.

It does not apply to the establishments if there is no work performed like intermittent.

It does not apply to establishments located in the SEZ Special Economic Zone).

    Contractor Under Section (2) Of The Act:
    A contractor is a person who takes over the chance to form a provided result for the reason of establishment, when compared to the supply of services or goods of manufacturers to such establishments, through the person or contract labour who offers contract labour for any establishment work and also holds a subcontractor.
    Central Advisory Board:
    The total members that are not more than seventeen but also should not be less than eleven. This is because the central government will stipulate to embody the government, the coal industry, the contractors, the railway sector, the workmen, and other sectors who have an idea of the central government to embody the central board.

    Advisory Boards:

    The central government under section 3 is predicted to set up the Central advisory Labour contract board on different activities relating to the act of administration. The Central board contains the following.

    State Advisory Board:

    The state board needs to hold the following aspects namely

    Labour Contract Registration Process:

    Every registration of establishments that proposes to employ various workers as well as contract workers for several works to acquire a registration certificate from the central or state government. Here is the process for employment registration for Labour Contract.

    The employer should contain the registration application in Form no 1 and also the payment receipt of the specified fee when approaching the registering office.

    If the registration application matches all conditions and aspects, the officer will register the labour contract registration and provide a copy of the registration certificate in Form -II.
